The Nazareth District Court acquitted a man accused of raping an 82-year-old Holocaust survivor on Monday, saying that the relationship was consensual.


Adel Hiev, who had previously served prison time for sexual assault, gave a more compelling recollection of events according to the court, and evidence indicated that he was even paid NIS 300 for the intercourse.


The two reportedly conversed cordially in recorded phone calls, and in sexual banter. The court said that the woman allegedly offered to introduce the accused to her friends for sexual services.


Israel Women's Network CEO Hadas Daniely Yelin attacked the ruling as a failure of justice, saying that responsibility lies with the attacker to ensure consent, not the victim to object. She said that it was not possible that a sex offender had gone on to harm another woman, and urged the State Attorney's Office to appeal the decision.

The district court in Nazareth acquitted 43-year-old Adel Hiev of raping an 82-year-old Holocaust survivor on the grounds that the prosecution did not prove that the elderly objected to his actions. The indictment filed against him by the prosecutor's office states that "Hev raped the complainant even though he was under the supervision of the Security Service following his release from prison for the rape of a 70-year-old."

In the verdict, the judges argued: "It was not proven that the accused raped the complainant without her consent, and it was not proven that the complainant said 'no' time and time again, just as it was not proven that the complainant showed passive resistance in one way or another - from which the accused could have learned that the complainant refused to comply Relationships that were coordinated between them."

According to the indictment, in July 2022 Hav met the Holocaust survivor on the street and complimented her. A conversation developed between the two. He introduced himself as a repairman and the elderly woman invited him to her home for renovation work. When they entered her home, he pushed her into the bedroom, brutally assaulted her and raped her.

She was rushed to Ziv Hospital in Safed bruised and bleeding, and as a result of the injury she needed emergency surgery. In court, it emerged that the 70-year-old woman Shahev attacked also suffered physical injuries when he raped her. He was released about six months before the present case, and was under the supervision of the Tsur unit of the Shavas. Heev served 14 years in prison for various offenses.

On the other hand, in the verdict, the judges present a different picture. From the discussion today, it emerged that in the preliminary conversation between the complainant and the defendant, the main topic was apparently the sexual services that he wanted to provide to the complainant and her friends. The handover of the complainant's phone number to the accused was not done for the purpose of coordinating work to replace a door, but for the purpose of coordinating a sexual encounter.

The judges also referred to the conversations that Heev recorded, and according to the court contradicted the testimony of the complainant. "Most of the conversations had a sexual nature and even a blatant sexual nature. The complainant fully cooperated with these conversations. At least one conversation was initiated by the complainant. In this last conversation, there is a 'cover story' between the complainant and the defendant according to which he will come 'supposedly' to fix a television in the bedroom of her home of the complainant".

"The defendant's version of this matter was not hidden," the judges continued. "He came for a sexual encounter and after prior arrangement. They sat for a few minutes in the kitchen and talked, and then the complainant led him to her bedroom. The defendant emphasized that he knew that her husband, who is in a serious nursing condition, and a foreign worker who takes care of him also live in the complainant's apartment. The conclusions from all of the above are that from the beginning both the complainant and the accused knew what he had come for, and the move to the bedroom was also planned for sexual contact."

According to the head of the panel of judges in the decision, Judge Asher Kola, who also acquitted Zadorov, "The complainant did not testify in a coherent and consistent manner, and avoided giving answers to some of the questions, both in the hearing before us and also in the police investigations. It will be noted and emphasized that the accused is certainly not 'Tallit Shkolah Klekhlet', certainly that the accused violated the provisions of the supervision order imposed on him, and he is the one who made blatant sexual proposals to the complainant. However, from here to being accused of brutal rape, the distance is long, even very long."
