In the ruling, Kasirer noted that the court’s decision striking down the provision “has no impact on the rule that intoxication short of automatism is not a defence to violent crimes of general intent, such as assault or sexual assault.”

Took a couple law classes in high school but basically it surrounds a concept we have here called "automatism" which is a state of unconsciousness in which someone is not able to control their behaviour fully in that state and basically think things through, while being in that state.

There's this thing called "insane" automatism where someone does something because of a mental illness (disease of the mind) and it's used as a defense in court in which the defendant can basically get declared not criminally responsible for the supposed crime they were accused of committing.

This new ruling is basically saying that this will only be a defense for automatism that may have happened while drinking. If you could prove that it was automatism than you can get away with it but everything short of that and just claiming you were drunk would not be an acceptable defense.

Back in communist Romania being drunk when committing a crime was an aggravating circumstance, you were punished more severely for this. People who were drunk, drove and killed someone in an accident would even flee the scene of the crime and waited until they were sober to surrender to the police, the punishment for fleeing the scene of an accident was less than the punishment for committing the accident intoxicated...
