McCallum made the statement in a July 2018 affidavit responding to the plaintiff’s lawyer, Simona Jellinek.


“She states that the alleged assaults took place while the plaintiff was ‘in childhood,’” McCallum wrote, before noting that the plaintiff’s year of birth indicates she would have been about 14 or 15 in the early 1980s.
A girl that age is “a sexually mature young woman, not a ‘child,’ as the term is conventionally understood,” McCallum wrote.

“As it is difficult to imagine a reasonable person concluding that the reference to ‘childhood’ … was an implicit reference to alleged pedophilia, we have difficulty accepting that this is what Mr. McCallum actually thought when he swore his affidavit,”

14 is in fact too young specially if theres a considerable agegap (5+ years) but this case is obviously a crime by several other things than age, mainly the fact that the perpretator was a foster parent and it was rape (non statutory rape, actual rape), the latter by itself already qualifies it as a crime obviously
