Key ways they judged agitation and risk:


  • Immediate behavior
    • Rapid pacing, clenched jaw/fists
    • Staring intensely at people (especially witnesses or jurors)
    • Smirking, laughing at testimony, muttering
    • Sudden posture changes (leaning forward, tightening up)
  • Verbal cues
    • Threats, even indirect
    • Aggressive tone, sarcasm, taunting
