In Deuteronomy 22:25–27 there is a different case

If a woman is raped in the countryside, only the man is punished (even executed).

That suggests the law distinguishes between violent rape and other cases (possibly consensual or ambiguous situations).

Here it is most likely pointing to seduction outside of marriage.

Also, if a woman wasnt a virgin, she would probably be super poor. If the man did the deed and was executed she probably would have lived in the streets or something as virginity was very important.
