No, he can go to the bank, take out a HUGE loan, and put his stock up as collateral. So he takes out a 1 million dollar loan, says "if I do not pay, I will give you 1.25m in SpaceX stock"
Bank says ok, Elon gets the 1m, doesn't pay it back, bank gets 1.25m, they knew it would happen, but they are happy since they technically made 250,000 which they can invest with
