Although a warning for this is deserved, what isn't is a second punishment.

A punishment with a lag time...

He had already received a warning for this "spam" behaviour - fully deserved.

But then today, he got ANOTHER warning for the same thing - undeserved.

and this resulted in a ban...

If you repeat the offense more than once, you can get warned for it more than once.

If you spam pornography on the forum all in one day, just because you were warned for it once during that day doesn't mean moderators are not able to go back and warn you for every offense. It's also why we ban users who do this; because it wouldn't make sense to give users a hall pass to make a single offense as much as they want within a day just to end up in 1 warning.

Most content, when not reported, depends on the moderator stumbling upon it. If the content is continuously being stumbled upon organically, it means that users are running into it. It makes sense for moderators to warn content when they run into it.

Also you're technically correct. Spam is the offense of normally posting low effort repetitive content, so it's normally an action, and epilepsy is deemed as an issue with the content itself.
