How come some people just get scammed for surgery

I have seen numerous threads about niggas getting scammed from their surgeon, for example some guys got canceled cause his surgeon didn’t think he was mentally right after he already paid him and didn’t get a refund, there are so many other cases like this. How the fuck does this work, couldn’t you just sue the surgeon if he doesn’t refund you ? Most people lose their money and never get it back
