He said in Al-Insaf (8/309): “The judge said in response to a question: Intercourse with a dead woman is forbidden.”
Al-Kasani said in Bada'i' al-Sana'i': "Similarly, having intercourse with a dead woman does not warrant the hadd punishment but does warrant taazeer punishment."
Ibn Abidin said in his book Hashiyat Radd al-Muhtar 'ala al-Durr al-Mukhtar (4/60) The difference between the hadd punishment and the ta'zir is that the hadd punishment is predetermined and the ta'zir is left to the opinion of the imam, and that the hadd punishment is averted by doubts and the ta'zir is obligatory with them, and that the hadd punishment is not obligatory on the child and the ta'zir is prescribed for him.
