The thing is that theoretically all those crimes are recorded and then later you get sentenced for war crimes. But they know all kind of fucked up shit happens in wars so you may get a less severe sentencing. Most of the time though they just won't find evidence due to the chaos in war. And they can not thoroughly investigate all the many crime cases. So realistically most of what happens will never end up in court.
