Can I sue a dr for misdiagnosis of nerve injury?

Am I able to sue my orthopaedist for misdiagnosis of Cubital Tunnel (entrapment of the ulnar nerve in the elbow), if I in fact had Thoracic Outlet Syndrome (entrapment at the shoulder), and he refused to check my shoulder for signs of atrophy despite having muscular atrophy in my shoulder a few months after I was checked by another doctor? Would there be enough evidence to support this?

No u can't before performing surgery they make u sign contract with States they won't be liable for any misshapening

It's not from the surgery, he misdiagnosed me and did the incorrect surgery for something that I didn't actually have (nerve was of normal appearance), and didn't check my shoulder for signs of atrophy despite me reporting symptoms, causing my already existing condition to worsen
